Terms of Service
These Terms of Service ("Terms") govern your use of the services provided by SpiceRoute Foods Pvt. Ltd. ("we", "us", "our") including online ordering, catering, subscription meal plans, and private chef bookings. By placing an order, subscribing, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our services and contact our bookings team for alternatives. Our registered address is 42 MG Road, Brigade Heights, Bangalore, 560001, India. You may reach us at +91 98450 12345 or [email protected] for questions regarding these Terms.
1. Services and Orders
We provide catering, meal subscriptions, private chef services, and single-order meals as described on the website. All orders are subject to availability and acceptance by us. For events, we provide a written proposal that outlines menu, staffing, equipment, and timing. The proposal must be accepted in writing and may require a deposit as described in the proposal. Delivery times are estimates and we will make reasonable efforts to meet agreed schedules, but we are not liable for delays caused by circumstances beyond our control including severe weather, traffic, supplier issues, or client-side delays at the venue.
2. Prices, Payment and Invoicing
Prices displayed on the site and in proposals are in Indian Rupees and exclude applicable taxes unless stated otherwise. For online orders we accept payment methods shown at checkout. For event services, payment terms are specified in the proposal. Deposits are non-refundable except where required by law or as otherwise agreed in writing. Final payment terms include any outstanding balances due before service or according to the schedule in the proposal. If payment is not received on time we may suspend services. We reserve the right to correct pricing errors, and corrected pricing will be communicated promptly.
3. Cancellations, Changes and Refunds
Event cancellations and changes must be provided in writing. Cancellation policies are included in proposals; typically, cancellations received within a shorter notice period may incur charges to cover food, labour and equipment costs. For subscriptions, clients can pause or cancel based on the subscription terms; advance notice is required to align with delivery schedules. Refunds for pre-paid amounts are processed in accordance with the applicable cancellation terms and after any necessary deductions. For one-time orders, refunds are issued if we fail to provide the ordered goods or if there is a demonstrable quality issue that we cannot resolve. We investigate all quality or delivery complaints promptly and may request photographic evidence. Where appropriate, we will arrange a replacement, refund or credit in line with consumer protection requirements.
4. Dietary Requirements and Allergens
We label common allergens and provide dietary options. However, cross-contact is possible in a shared kitchen environment. If you have severe allergies, inform us in writing and allow time for assessment. We will take commercially reasonable measures to reduce risk but cannot guarantee a completely allergen-free environment unless otherwise agreed. Clients are responsible for notifying guests of allergens and for selecting appropriate menu items for guests with dietary restrictions.
5. Liability and Indemnity
To the extent permitted by law, our liability for direct loss arising from our services is limited to an amount equal to the fees paid for the relevant services. We are not liable for indirect, special, punitive or consequential losses including loss of profit, reputation, or business opportunity. You agree to indemnify and hold us harmless from third-party claims arising from your breach of these Terms, misuse of our services, or inaccurate information provided to us. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or other matters where liability cannot legally be excluded.
6. Intellectual Property
All content on our website and materials provided in proposals, menus, and marketing (including text, imagery, recipes presented for promotional purposes and design) are owned or licensed by SpiceRoute Foods. You may not reproduce, distribute or create derivative works without our written permission. Clients may use menus and descriptions provided for their event communications where we have been engaged, subject to attribution requirements if requested. Third-party trademarks remain the property of their respective owners.
7. Privacy and Data
We handle personal information in accordance with our Privacy Policy available at /privacy/. By using our services you consent to the collection and use of personal data as described in the Privacy Policy. We retain customer data only as necessary for service delivery, legal compliance and legitimate business purposes.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be referred to mediation. If unresolved within 60 days, disputes will be subject to the exclusive jurisdiction of the courts in Bangalore, India. This clause does not prevent either party from seeking urgent injunctive relief in any competent court.
9. Changes to Terms
We may update these Terms occasionally to reflect changes in our services or legal requirements. We will post updated Terms with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised Terms. For significant changes affecting past orders, we will provide notice where required by law.
